Terms of Service

1. The Service

PowerHour ("we", "us") provides an AI-powered sales outreach platform available at app.pwr-hr.ai. The platform enables users to find leads, generate personalised email drafts using AI, manage a CRM pipeline, and send emails through connected Gmail or Outlook accounts.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to use PowerHour. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@pwr-hr.ai if you suspect unauthorised access. You may not share your account with others or create multiple free accounts.

4. Third-Party API Keys

PowerHour integrates with third-party services (Apollo.io, OpenRouter, OpenAI, Anthropic, Google, Microsoft) using credentials you provide. You are solely responsible for:

• Obtaining and maintaining valid API keys and OAuth authorisations.
• Complying with the terms of service of those third-party providers.
• Any costs incurred on those third-party platforms as a result of your use of PowerHour.

We store your credentials encrypted at rest and use them solely to perform actions on your behalf that you initiate within the platform.

5. Acceptable Use

You agree not to use PowerHour to:

• Send unsolicited bulk email (spam) or violate anti-spam laws (including the UK's PECR, CAN-SPAM, or GDPR).
• Harass, threaten, or deceive recipients.
• Impersonate any person or organisation.
• Harvest data in violation of any website's terms of service.
• Circumvent, disable, or interfere with security features of the platform.
• Attempt to gain unauthorised access to other users' data or the underlying infrastructure.
• Use the service for any unlawful purpose.

We reserve the right to suspend or terminate accounts that violate these rules without refund.

6. Email Compliance

You are solely responsible for ensuring your outbound email campaigns comply with applicable laws and regulations, including the UK's Privacy and Electronic Communications Regulations (PECR), GDPR, and any laws in the recipient's jurisdiction. PowerHour provides tools to help with personalisation and volume management but does not guarantee compliance on your behalf. B2B outreach to business email addresses under a legitimate interest basis is generally permitted under UK PECR; you should seek independent legal advice if unsure.

7. Subscription and Billing

• Paid plans are billed monthly or annually in advance via Stripe.
• New subscriptions include a 7-day free trial. You will not be charged until the trial ends.
• Prices are listed on the sign-up page and in your account settings. We reserve the right to change prices with 30 days' notice.
• Subscriptions automatically renew unless you cancel before the renewal date via your account's Billing settings.
• Except where required by law, fees are non-refundable once a billing period has begun.
• If payment fails, your account may be downgraded to the free plan after a grace period.

8. Intellectual Property

PowerHour and its underlying software, design, and branding are owned by us and protected by intellectual property law. You retain ownership of the content you create (leads, emails, brain files). You grant us a limited licence to store and process your content solely to provide the service.

9. AI-Generated Content

The AI features in PowerHour generate draft content that requires your review before sending. You are responsible for reviewing all AI-generated drafts and for the content of any emails sent from your accounts. PowerHour does not guarantee the accuracy, quality, or appropriateness of AI-generated content.

10. Limitation of Liability

To the fullest extent permitted by law:

• PowerHour is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted or error-free operation of the service.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost profits, lost leads, or reputational harm.
• Our total liability to you for any claim arising from these Terms shall not exceed the fees you paid to us in the 3 months preceding the claim.

Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Termination

You may close your account at any time via Settings → Billing or by contacting us. We may suspend or terminate your account immediately if you breach these Terms. Upon termination, your right to access the service ceases and your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or in-app notification at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree to the changes, you may close your account before they take effect.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
